Across the country, state trial courts are inundated with high volumes of debt collection lawsuits. These lawsuits frequently result in judgments for the creditor, often by default, and may lead to seizure of consumer wages or money in a bank account.
This webinar presents three policy resources and discusses how they can be used in efforts to reform state laws related to debt collection lawsuits and post-judgment collection.
Policy Resources:
- National Center for Access to Justice, Justice Index: Consumer Debt Litigation Index (Feb. 2024) – Ranks 50 states and DC on whether they have adopted certain best policies for fairness in consumer debt litigation, and elevates the policies to support their adoption in more states.
- Temple University Beasley School of Law, Center for Public Health Law Research, State Debt Collection Litigation Laws (Feb. 2024) – Provides an overview of state statutes, regulations, and court rules governing debt collection lawsuits that were in effect as of January 1, 2023.
- National Consumer Law Center (NCLC), No Fresh Start 2023: Will States Let Debt Collectors Push Families Into Poverty as the Cost of Necessities Soars? (Dec. 2023) – Compares post-judgment exemption laws protecting wages, bank accounts, homes, cars, and household goods.
