On July 28, 2025, FHFA issued a proposed rule to repeal the 2024 Fair Lending Rule, which provided a legal framework for ensuring GSE compliance with the Fair Housing Act, the Equal Credit Opportunity Act, and the FTC Act’s prohibition on Unfair or Deceptive Acts or Practices (UDAP). The current rule also requires Fannie Mae, Freddie Mac, and the Federal Home Loan Banks to issue public Equitable Housing Finance Plans. If repealed, this action would exacerbate the nation’s fair and affordable housing crisis by unfairly shutting out many people from the American Dream of safe, stable, and affordable housing while undermining the safety and soundness of the housing finance system. This comment letter strongly urges FHFA to preserve the existing fair lending regulation.
