Appearing in Bloomberg Law on September 2, 2025, Angelica Serrano-Roman interviews NCLC Senior Attorney John Rao about how the Senate is expected to consider raising Chapter 13 debt limits—a move that practitioners say would ease pressure on consumers from housing costs and student loans.
A regular consumer won’t opt for liquidation or Chapter 11 — especially if they want to keep property.
John Rao, senior attorney with the National Consumer Law Center.
“Chapter 11 isn’t likely just because of the cost involved, particularly if you’re talking about someone who is truly just a consumer. It’s possible they could file Chapter 7, but if they were looking to Chapter 13, it’s likely not going to provide the relief they were hoping for.”
