These comments request that the Bankruptcy Rules Committee consider an amendment to Rule 3001(c) to fix a substantive change made by the restyling of the rule that may have limited the ability of a bankruptcy court to impose sanctions for creditor noncompliance with the proof of claim requirements.
These comments respond to proposed amendments to the Massachusetts Division of Banks (DOB) debt collection and mortgage servicing regulations. The comments raise concerns about DOB’s proposal to replace existing regulations with federal debt collection regulations (Regulation F) and to exempt “passive debt buyers.” The comments also propose suggestions to strengthen the DOB’s mortgage servicing regulations.
NCLC and AARP Wisconsin agree with the proposal to limit debt adjustment fees to a percentage of savings, but 30% is too high. NCLC and AARP Wisconsin also recommend more robust annual data reporting, prohibiting licensees from advising consumers to default on debts, and adopting other protections found in the FTC’s debt relief services rule.
